These Terms of Use ("Terms") govern your access to and use of the PixelPro.io subscription service ("Service") provided by Drewsif Design, LLC, doing business as PixelPro.io ("PixelPro.io," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.

1. Description of Service

PixelPro.io is a subscription-based service that provides users with access to downloadable resources ("Resources") for use in content creation. The Service is available to individual users and businesses under specific subscription plans.

2. Eligibility

You must be at least 18 years old to use the Service. By subscribing, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Subscription Plans

3.1 Personal Standard Subscription

  • A Personal Standard Subscription allows one individual user to download and use Resources for content associated with a single personal channel or project.

  • Resources may not be used for commercial purposes under a Personal Subscription.

  • Sharing Resources with others or using them across multiple channels or projects is prohibited.

3.2 Business Subscription

  • A Business Subscription is required for any commercial use of Resources, including but not limited to use in business-related content, marketing, or products.

  • Each Business Subscription covers one business entity and its associated commercial projects.

  • Businesses must maintain an active subscription to continue using Resources for commercial purposes.

4. License and Usage Rights

  • Personal Use License: Under a Personal Standard Subscription, PixelPro.io grants you a non-exclusive, non-transferable, revocable license to use the Resources for personal, non-commercial projects associated with a single channel or project.

  • Business Use License: Under a Business Subscription, PixelPro.io grants you a non-exclusive, non-transferable, revocable license to use the Resources for commercial purposes, provided the subscription remains active.

  • Restrictions: You may not redistribute, resell, sublicense, or share Resources with third parties, nor use them in a manner that violates these Terms or applicable laws. All rights not expressly granted are reserved by PixelPro.io.

5. Billing and Cancellation

  • Billing: The Service is billed on a monthly or annual basis, depending on the selected plan. You authorize PixelPro.io to charge your provided payment method for the subscription fees.

  • Cancellation: You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of the current billing cycle.

  • Post-Cancellation: Upon cancellation, you must immediately cease using the Resources. Businesses must remove Resources from all commercial content upon expiration of their subscription.

6. Intellectual Property

All Resources are owned by PixelPro.io or its licensors and are protected by copyright, trademark, and other intellectual property laws. Unauthorized use of Resources beyond the scope of your subscription may result in termination of your account and legal action.

7. Account Termination

PixelPro.io reserves the right to suspend or terminate your account for violation of these Terms, including but not limited to unauthorized sharing of Resources, misuse of the Service, or failure to pay subscription fees.

8. Disclaimer of Warranties

The Service and Resources are provided "as is" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, PixelPro.io shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or Resources, even if advised of the possibility of such damages.

10. Governing Law

These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Hillsborough County, New Hampshire.

11. Changes to Terms

PixelPro.io may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website or through the Service. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.
